Terms of Service

1. Who provides you the service

The Bloomia (bloomia.ro) platform is operated by Bloomia. Contact: neaua_neaua@yahoo.com.

By creating an account or using the platform, you accept these terms. If you don't agree with them, don't use the service.

2. Description of the service

Bloomia lets teachers and educators create interactive activities (quizzes, educational games) and share them with students via a link or QR code. The platform offers a free plan and paid plans, with different features, described on the Pricing page.

3. Who can have an account. Minimum age

  • Teacher accounts are created by persons with full legal capacity (18 years or older) or by representatives of an educational institution.
  • Students can play without an account. This is the recommended mode in class: the student opens the link, types their first name and plays. No email is requested and no account is created.
  • Student accounts (for XP, badges and leaderboards) can be created from age 16. Below 16, the consent of the holder of parental responsibility is required, under Art. 8 GDPR and Romanian law. By creating an account for a child under 16, the parent or guardian confirms they give this consent.
  • You may not transfer your account to another person and may not use someone else's account.
  • The information in your account must be true and up to date.

4. Your responsibilities

Part of the service's security depends on you. You are responsible for:

  • Account and password security. Choose a strong password, unique to this platform, and don't reuse it from other sites. Don't share your password and don't leave your account open on devices others can access. All actions performed from your account are considered yours.
  • Immediate reporting of any unauthorized use of your account, to neaua_neaua@yahoo.com. Until you notify us, we have no way of knowing the access is illegitimate.
  • The content you upload — its legality, pedagogical accuracy and respect for third-party copyright.
  • The student data you enter. If you use the platform with your students, you (or your institution) decide what data to ask them for and must have the legal basis for it. We recommend not asking students for full names or other personal data in activity fields — a first name is enough for the leaderboard.
  • Compliant use of the platform: complying with these terms, the interface instructions and applicable law.
  • Your own backups. You can export your data anytime from Profile → Security. For content you rely on, keep your own copy.

We are not liable for damages that result directly from failing to meet these obligations — for example, a third party accessing your account because of a weak, reused or disclosed password, or losing content you deleted yourself.

5. User content

By publishing content on Bloomia:

  • You retain your intellectual property rights over your content
  • You grant Bloomia a non-exclusive, royalty-free, transferable, unlimited-duration license, valid worldwide, to host, store, reproduce, technically adapt (resize, convert format), display and distribute the content within the platform and in its promotional materials
  • You guarantee that you hold the necessary rights and that the material doesn't infringe third-party rights
  • You guarantee it doesn't contain illegal, offensive or child-inappropriate material

What happens to your content if you delete your account

The license granted above survives deletion of your account. Activities you've published stay available on the platform, but are disassociated from your identity: your name no longer appears as author, and their administration passes to Bloomia.

The reason is that other teachers and students use published activities, and abruptly removing them would disrupt their lessons. If you want a specific activity actually deleted, delete it from your account before you delete your account, or write to us at neaua_neaua@yahoo.com.

If you hold a copyright and believe material on the platform infringes it, write to us at neaua_neaua@yahoo.com with a description of the material and the right invoked. We review the report and, if it's well-founded, remove the material.

6. Acceptable use

It is prohibited to:

  • Use the platform for illegal or unauthorized purposes
  • Publish violent, discriminatory or sexually explicit content
  • Attempt unauthorized access to our systems or other users' accounts
  • Conduct security testing without our prior written consent
  • Automatically scrape content or deliberately overload the service
  • Create multiple accounts to bypass the Free plan's limits
  • Resell or redistribute Bloomia's services without written consent

7. Subscriptions and payments

  • Subscription prices are those shown on the Pricing page at the time of the order. Prices don't include VAT — we're not VAT-registered.
  • Card payments are processed via Stripe; we don't have access to your card details
  • Subscriptions paid by card renew automatically until you cancel them. Those paid by bank transfer do not renew automatically
  • Cancellation can be done anytime from Profile → Subscriptions and payments; access remains active until the end of the already-paid period
  • Price changes don't affect the already-paid period and are announced to you before renewal

Right of withdrawal (consumers)

If you're a consumer (an individual acting outside their professional activity), you have the legal right to withdraw from the contract within 14 days of its conclusion, without giving a reason and without penalties (Government Emergency Ordinance no. 34/2014).

The service is provided to you immediately after payment. By placing the order, you expressly ask us to begin providing it during the withdrawal period and confirm you understand you lose the right of withdrawal once the service has been fully performed. If you withdraw within the 14 days, we refund the amount proportional to the unused remaining period.

Beyond the legal minimum: we offer you a 30-day money-back guarantee from your first purchase. Write to us at neaua_neaua@yahoo.com and we refund the full amount, no questions asked.

8. Service availability

We make reasonable efforts to keep the platform continuously available, but we don't guarantee uninterrupted or error-free operation. We may perform maintenance work, announced in advance when planned. We don't offer a guaranteed service level (SLA) for the Free plan.

9. Suspension and termination

We may suspend or close an account, with prior notice where possible, if:

  • these terms are breached, especially the "Acceptable use" section;
  • the account is used in a way that endangers the security of the platform or other users;
  • there is a legal obligation to do so.

If you're suspended without fault on your part, we refund the unused portion of your subscription. You can close your account yourself, anytime, from Profile → Security.

10. Limitation of liability

Bloomia is provided "as is". To the extent permitted by law, we are not liable for indirect damages (loss of profit, data or opportunities) resulting from the use or inability to use the service, and our total liability is limited to the amount you've paid us in the last 12 months.

In particular, we are not liable for: user-created content; unauthorized account access due to a weak, reused or disclosed password; use of the platform contrary to these terms; or unavailability caused by third-party services or your internet connection.

What cannot be limited: these limitations don't apply to fraud or gross negligence, personal injury, the rights that consumer-protection law grants you imperatively, or our liability as data controller under GDPR. No clause in this document restricts the rights the law grants you.

11. Force majeure

We are not liable for failure to perform our obligations caused by events beyond our reasonable control: natural disasters, armed conflicts, communication or power network outages, large-scale cyberattacks, or actions by authorities.

12. Data protection

How we process personal data is described in the Privacy Policy, which is an integral part of these terms. For student data you enter as a teacher or institution, the roles are explained in the "Student data" section of that same policy.

13. Changes to these terms

We reserve the right to change these terms. You'll be notified by email at least 14 days before significant changes take effect. If you disagree, you can stop using the service and we'll refund the unused portion of your subscription. Continuing to use the service after the changes take effect constitutes acceptance of the new terms.

14. Governing law and dispute resolution

These terms are governed by Romanian law. We first try to resolve any complaint directly — write to us at neaua_neaua@yahoo.com.

If you're a consumer, you can turn to ANPC or use the European Online Dispute Resolution (ODR) platform. The competent courts are those in Romania; if you're a consumer, you retain the right to bring proceedings before the court of your own domicile.
